Parents of transgender children in Texas can take a momentary breath of relief after a judge intervened to block Governor Abbott’s controversial policy that categorized gender-affirming care for trans minors as “child abuse.” The ruling calls for the Texas Department of Family and Protective Services to halt investigations into families who support their children’s medical choices and autonomy regarding their bodies.

This judicial action stemmed from a lawsuit filed by the family of a teenage girl who faced the repercussions of Abbott’s directive. Ironically, the girl’s mother, an employee of the agency responsible for enforcing this new policy, sought hormone therapy and puberty blockers for her daughter but was subsequently placed on leave. Investigators then visited their home.

Judge Amy Clark Meachum of Travis County’s 201st Civil District Court determined that the directive was unlawful, highlighting that not only could the mother potentially lose her job, but the family also faced “imminent and ongoing deprivation of their constitutional rights, the potential loss of necessary medical care, and the stigma attached to being the subject of an unfounded child abuse investigation.” The judge has also scheduled a hearing on March 11 to further evaluate the policy’s implications.

The family involved in the lawsuit expressed their distress. “We are terrified for [our daughter’s] health and wellbeing, and for our family,” the mother stated in a declaration submitted with the lawsuit by the American Civil Liberties Union and Lambda Legal. “I feel betrayed by my state and the agency for whom I work.”

While the ruling has brought some joy to many, the ACLU cautioned that this is merely a “partial” victory. “We appreciate the relief granted to our clients, but this should never have happened and is unfathomably cruel,” attorney Brian Klosterboer remarked. “Families should not have to fear being separated because they are providing the best possible health care for their children. Elected leaders and agencies should not play politics with people’s lives. We will do all that’s possible to stop these abuses of power and ensure transgender young people can receive medically recommended treatment.”

During the State of the Union address, President Biden condemned the recent surge of transphobia in Texas. According to the Trevor Project, 82% of transgender individuals have contemplated suicide, and 40% have attempted it. Gender-affirming care can be life-saving for these young individuals.
