In a troubling incident, a Black Army lieutenant is pursuing legal action against two Virginia police officers for allegedly holding him at gunpoint and using pepper spray during a traffic stop. The lieutenant, who was in full uniform, experienced this encounter in December while driving back from a drill weekend.
According to a lawsuit filed recently, Lieutenant Alex Carter was pulled over for what authorities designated as a “felony traffic stop.” After stopping at a well-lit gas station in Windsor, Virginia, the officers began shouting commands at him. Footage from the incident shows one officer aiming his firearm at Carter, who expressed fear about exiting his vehicle.
“I’m honestly afraid to get out of the car,” he remarked, to which Officer Mark Sullivan responded, “Yeah, you should be.” The situation escalated when Officer Sullivan approached Carter’s vehicle and pepper-sprayed him. After Carter exited the SUV, he was struck behind the knees and threatened with a taser if he did not comply. As the officers cuffed him, he was heard expressing his disbelief at the treatment he was receiving.
Moreover, the officers allegedly warned Carter that if he lodged a complaint, they would charge him with obstruction, eluding, and assault on a law enforcement officer—accusations that could jeopardize his military career.
Carter has since retained legal counsel, asserting that the officers pulled him over due to his SUV lacking permanent license plates. However, he had temporary plates displayed inside the rear window. The officers claimed that he was “eluding police” and treated the situation as a serious offense.
On April 2, Carter filed a lawsuit against Officers Sullivan and David Brooks, alleging that their actions violated his Fourth Amendment rights through excessive force and racial profiling. “He’s a sworn member of the United States Army,” stated Jonathan Taylor, Carter’s attorney, “and the conduct of these officers directly undermines the oath he took.”
This encounter has understandably left Carter shaken and concerned about potential retaliation.
